The publication CHAMBERS EUROPE –probably the most renowned and prestigious in the European legal area - has chosen our managing partner Emiliano Garayar as Number 1 in Spain on Energy legal advice in 2009 (latest publication available; same recognition given as well as in 2006, 2007 and 2008). Javier de Montalvo is also one of the outstanding lawyers in the nationwide energy sector.

YEAR 2010:

Public Law:

This relatively compact but solid independent firm was established in Madrid in 2006, and is gaining ground in the Spanish market. The public law practice is comprised of five lawyers dedicated to administrative matters, with particular expertise in finance, energy and infrastructure. The group has clout in Santander, where it is advising CEP Cantabria on a project to build and manage one hospital and four health centres in the region. In the energy sector, the firm advises Endesa and its subsidiaries on various public law issues. Commentators applaud energy regulatory specialist Gervasio Martinez-Villaseñor for his commitment to his clients. Managing partner Emiliano Garayar brings expertise in finance and infrastructure to the team.

Competition/European Law:

This independent Spanish firm was established in 2006 and has proved extremely popular with clients, who say: “The firm provides an excellent service and has a young and hard-working team of lawyers offering expertise in competition and administrative law.” The head of the department is Eduardo Abril, an energy specialist who advised Unión Fenosa on the takeover bid launched by Gas Natural. Clients praise him for “his deep knowledge and ability to translate technical subjects into practical, legal language."

Energy & Natural Resources:

Since being established in 2005 by a small group of lawyers from firms including Gómez-Acebo & Pombo, this boutique has grown rapidly in size and reputation. It now consists of around 15 practitioners, including the recently incorporated former legal counsel of the Unión Fenosa group, Alejandro Sánchez Bustamante, as senior of counsel. The firm comprises lawyers from a range of legal disciplines, including regulatory, competition, corporate and finance, but it is known predominantly for its expertise in energy and natural resources. Its formidable client and deal list is testament to the respect that it has earned in this field. Perhaps most notably, it advises the majority of the major utility companies in Spain, these being Endesa, Hidrocantébrico and Unión Fenosa – prior to its takeover by Gas Natural and subsequently as part of the Gas Natural group. As well as having a strong presence in the national energy and natural resources market, the group advises important international players, including Danish company Vestas, which is the largest supplier of wind turbines in the world. “Brilliant” name partner Emiliano Garayar, who is also managing partner of the firm, is applauded for his “great expertise in the energy sector,” in particular the regulatory aspects. He was heavily involved in representing Unión Fenosa in its recent EUR16.75 million takeover by Gas Natural. Javier de Montalvo has been remarkably active over the past year, advising several clients including Red Eléctrica and renewable energy operator Renovalia on a wide range of matters. Sources highlight his negotiating abilities, analytical skills and capacity for work, and state that “he combines excellent technical knowledge and common sense.”

YEAR 2009:

Garayar Asociados

This boutique focuses on the energy area, and has an excellent level of technical know-how when it comes to regulations and their implications in the sector. The market welcomes the recent recruitment of a number of junior lawyers, enabling the team to keep up with its growing activity and an increasing volume of work. It is currently the counsel of Unión Fenosa, which the team is assisting with the commercial, competition and regulatory aspects of its EUR16.75 million acquisition by Gas Natural. Interviewees acknowledge that energy partner Emiliano Garayar is clearly a formidable player in the market and enjoys a high profile in regulatory and competition matters. One client commented: "It's a shame that there aren't more lawyers as good as Emiliano - he's unquestionably one of the most knowledgeable experts in the industry." Market sources praise Javier de Montalvo's strong personality and great advice in the energy sector”.
